Terms of Service

By creating an account or using ROIthink (the "Service") you agree to these Terms of Service ("Terms"). If you are accepting these Terms on behalf of an organization, you represent that you have authority to bind that organization.

ROIthink is a multi-tenant CRM platform operated by Abad & Alban Group. Each customer ("Tenant") receives an isolated workspace and may invite users, store contacts, send communications, build funnels, run workflows and integrate third-party providers. The platform is offered as a subscription with tiers described at /pricing.

• You must provide accurate registration information and keep your credentials confidential.
• You are responsible for all activity under your account, including activity by users you invite.
• You must be at least 16 years old to create an account.

You agree not to use the Service to:

• Send unsolicited bulk email, SMS or calls in violation of CAN-SPAM, TCPA, GDPR or any applicable law.
• Distribute malware, phishing content, or otherwise harm recipients of your messages.
• Infringe the intellectual property or privacy rights of others.
• Attempt to bypass tenant isolation, rate limits, or other security controls.
• Resell the Service or expose it to third parties as your own product without a separate written agreement.

We may suspend or terminate accounts that violate this section, with or without notice depending on severity.

You retain all rights to the data you upload or generate in the Service ("Tenant Data"). You grant ROIthink a limited license to host, process, transmit and display Tenant Data only as needed to provide the Service. We do not use Tenant Data, including data accessed via Google OAuth, to train AI models or for advertising purposes. See our Privacy Policy for details.

The Service integrates with third-party providers (Stripe, Twilio, SendGrid, Postmark, Google, Microsoft, Anthropic, OpenAI, and others). Your use of those providers may be subject to their own terms. We are not responsible for outages, billing or content provided by those third parties.

Paid plans are billed in advance via Stripe. Fees are non-refundable except as required by law. You authorize us to charge the payment method on file for recurring subscription fees and any usage-based charges (telephony, AI inference, email volume) as published in your dashboard.

You may cancel your subscription at any time from your account settings. Upon cancellation, your workspace enters a 30-day grace period during which it can be reactivated; after that, Tenant Data is permanently deleted as described in the Privacy Policy.

The Service is provided "as is" and "as available". We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the maximum extent permitted by law.

To the maximum extent permitted by law, ROIthink and its affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues. Our aggregate liability for any claim arising out of these Terms will not exceed the fees you paid us in the twelve (12) months preceding the event giving rise to the claim.

We may update these Terms from time to time. Material changes will be communicated via the Service or email at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
